These are the Terms and Conditions that govern the use of INARTIK and all its related sites and Services. By using INARTIK Platform, you agree to these Terms and Conditions. If You do not agree to these Terms and Conditions, please do not access, or use the Platform. |

The following terms and conditions shall apply to all users in relation to the services provided by platform " INARTIK " These Terms and Conditions come into force once You accept Service through the Platform or through any other form of communication with INARTIK. |
|
Please note that You should review and agree with our Privacy Policy [PP’s LINK] as it is an integral part of these Terms and Conditions. |
|
This Agreement supersedes any prior agreements or arrangements between INARTIK and You. INARTIK may immediately terminate this Agreement and/or any provision of Services thereunder, or generally cease offering or deny access to the Services or any portion thereof at its sole discretion, at any time for any reason, without incurring any liability towards You. |
|
The User agrees and accepts that the use of the Platform and the Services provided by INARTIK is at the sole liability of the User, and further acknowledges that INARTIK disclaim all representations and warranties of any kind, whether expressed or implied. |

Definitions |
|
The following definitions apply to the Terms and Conditions set out below. These Terms and Conditions, along with the Privacy Policy, hereby set out the whole agreement and understanding between " INARTIK " and the “User” (the Agreement”). whether an individual or entity that accesses Our Platform. |
|
“We”, “Us”, “Our”, the “Company”, “INARTIK” and “Platform” shall refer to INARTIK, its employees, and authorized agents. |
|
Users: are individuals who benefit from the platform's services as outlined in this terms and conditions ,This includes "children" who use the platform under the supervision of their parents. |
|
Services: means INARTIK’s Services as described by these Terms and Conditions. |
|
Platform: means the INARTIK Platform, which is owned by Inartik for Garment Trading an LLC and registered in the Cairo Investment Commercial Register under No. 247989 which the services provided are used by users. |
|
Children: Refers to users who are children and benefit from the platform's services. |
|
Parents: Refers to the parents or legal guardians of children who use the "INARTIK" platform. |
|
Force Majeure: means an act of God, including but not limited to fire, floods, storms, hurricanes, typhoons, volcanic activities, or earthquakes, as well as acts, orders, or requests of a sovereign or a government and /or of anybody purporting to be or to act for such authority, wars, whether declared or not, war-like actions, revolutions, riots, civil insurrections, or civil commotions, as well as strikes, lockouts and/or similar actions in labor disputes, and any other comparable cause beyond the control of a party unless its performance has been expressly guaranteed by expressly waiving the exemption of a Force Majeure event. |

Applicable Laws: means the laws of the Arab Republic of Egypt. |
|
Eligibility |
|
If you are registering as a business entity, you represent that you have the authority to bind that entity to Terms and Conditions and that you and the business entity will comply with all applicable laws and terms governing the use of the Platform. |
|
Accounts and Registration |
|
To benefit from the Services, you should provide INARTIK Platform with all required information in order to create your Account and allow INARTIK to provide you with the Services. Otherwise, you shall navigate the Platform as a guest. |
|
INARTIK Platform may ask you to provide some personal data including but not limited to your full name, email address, mobile phone number, and some financial data. |
|
You agree to maintain true and accurate, complete, and up-to-date information in your Account. You are responsible for all activity that occurs under your Account, and as such, you agree to always maintain the security of your Account username and password, unless otherwise permitted by INARTIK in writing. |
|
Accounts are not transferable. You agree to reimburse INARTIK for any improper, unauthorized or illegal use of your Account by you or by any person obtaining access to the Platform, Services or otherwise by using your designated username and password, whether you authorized such access. |
|
You agree that you are solely responsible for all activities that occur in connection with your account on INARTIK Platform and you shall notify us immediately of any unauthorized use of your account. |
|
We may terminate or suspend access to your Account or your ability to use the Services, in whole or in part, at our sole discretion, for any or no reason, and without notice or liability of any kind. For example, we may terminate or suspend your Account or ability to use the Services if you misuse the Platform. Any such termination or suspension could prevent you from accessing your Account. |
|
If INARTIK suspects, at its sole discretion, that any of the information you provided is untrue, inaccurate, incomplete, or not current, without prejudice to any other rights and remedies of INARTIK under these Terms and Conditions or under the Applicable Laws, we have the right to suspend or limit your access to the Platform and its Services. |
|
INARTIK may (in its sole discretion and at any time), make any inquiries it considers necessary (whether directly or through a third party), and request that you provide a response with further information or documentation, including without limitation to verify your identity and/or ownership of your financial instruments. Without limiting the foregoing, if you are a business entity or registered on behalf of a business entity such information or documentation may include your trade license, other incorporation documents, and/or documentation showing any person's authority to act on your behalf. you agree to provide any information and/or documentation to INARTIK upon such requests. You acknowledge and agree that if you do not, INARTIK without liability may limit, suspend or withdraw your access to the Platform. We also reserve the right to cancel unconfirmed/unverified Accounts or Accounts that have been inactive for a long time. |

All users registered on the platform must be parents or legal guardians of the children wishing to participate on the platform. Please ensure that you are legally responsible for the child registered on the online platform. |

Services |
|
INARTIK offers a variety of services aimed at providing a unique and exceptional experience for users of the online platform who are interested in purchasing and browsing clothing products: |

First: products varieties and description The online platform provides multiple categories of clothing, including men's, women's, children's, sportswear, and special occasion attire. Each product has a dedicated page containing high-quality images, details about the materials used, available sizes, prices, and multiple color options.. |
|
Second: special offers and discounts The online platform sends notifications to users regarding promotional offers, discounts, and new collections. Additionally, the platform provides special offers during holidays and various seasons, helping to attract customers. |
|
Third: helping tools AI: The platform provides clothing recommendations based on the user's preferences and purchase history, making it easier for customers to find clothing that suits their taste. |
|
Fourth: Return and exchange policy The platform offers a flexible return policy that allows customers to easily return or exchange products in case of defects or dissatisfaction. Additionally, customers can request product exchanges or refunds through the application. |
|
Fifth: purchase and payment methods The platform includes flexible payment options such as cash on delivery, credit card payments, or electronic payments. Users can also store payment details for faster purchases in the future. |
|
Sixth: Delivery and tracking The platform offers multiple delivery options and enables customers to track the status of their shipment in real time through the application. |
|
Seventh: customer services and direct support The online platform includes a live chat service with customer support to address any inquiries or issues encountered by users. Additionally, there is a FAQ section to guide customers and save time. |

Use of the Platform |
|
Subject to the User’s compliance with these Terms and Conditions, INARTIK grant the User a limited, non-exclusive, non-sublicensable, revocable, non-transferable license to: |

- Access and use the Services solely in connection with the provision of the Services. |
|
- Access and use any content, information, and related materials that may be made available through the Services. |
|
Any rights not expressly granted herein are reserved by INARTIK and may be revoked at any time without notice to the User. |
|
The user shall not use any trademark or intellectual property rights of INARTIK. Also the user ot shall any reverse engineering or reconfiguration be performed or linking any part of the Services to any reflective system and no part of the Services may be copied or framed or any software or text launched for the purpose of scraping, cataloguing, surveying, or extracting data from services in any other way or overload or impede the operation of any aspect of services, or attempt to access unauthorized services or weaken any aspect of associated services, systems or networks. |

The User may not post in anywhere else on the site (as determined at our sole discretion): solicitation, advertising, foul language, profanities, obscenities, culturally offensive material, religiously offensive material, critical political content, material that may threaten the public interest or national security, defamatory or libelous harassment, or other content that may be offensive or indecent. |
|
INARTIK offers some adventurous activities that may involve risks. We would like to emphasize that the responsibility for ensuring the safety of all tours lies solely and entirely with the user. The user must strictly follow the rules of the service provider during the trip. |
|
Electronic Communications |
|
By creating an account, you agree that you are communicating with Us electronically. Therefore, you consent to receive periodic communications from Us. INARTIK will communicate with you via e-mail or may send You information via text messages (SMS), as well as by posting notices on the Platform as part of the normal business operation of your use of the Services. You acknowledge that opting out of any of the said means of communication may affect your use of the Services. |

You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. |
|
INARTIK will request your agreement during the registration process to send you promotional emails or notifications related to the Platformand its Services. If at any time, you decide that you do not wish to receive promotional emails, you can opt-out of receiving such promotional emails by clicking on the link at the bottom of any promotional email. |
|
Payments |
|
INARTIK provides electronic payment services through electronic payment gateways. Payment will be processed through these gateways, and INARTIK is not responsible for any error, damage, or similar matter that the user may be exposed to as a result of or due to the use of the electronic payment method, as this is the responsibility of the user. |
|
INARTIK reserves the right to alter, change, modify, or provide the payment methods and the fees of the Services without prior notice. However, such changes will be reflected on the Platform prior to You ordering. |
|
You shall ensure sufficient coverage of the respective account that covers the orders and shall abide by the credit card transaction limits. The User shall agree to receive a receipt via email or text or through the Platform itself following Your payment of the fees. |
|
INARTIK shall not charge the Users any extra fees for making an online payment. Except for administrative expenses, which represent a percentage of (............) % of the payments. |
|
INARTIK Platform may (in its sole discretion and at any time), make any inquiries it considers necessary (whether directly or through a third party), and request that You provide it with further information or documentation, including without limitation to verify your identity and/or ownership of Your financial instruments. You agree to provide any information and/or documentation to INARTIK upon such requests. You acknowledge and agree that if You do not, INARTIK without liability may cancel the transaction, limit, suspend or withdraw your access to the Platform and/or your membership on the Platform. |

Copyrights and Trademarks |
|
All content included on the Platform including but not limited to text, graphics, INARTIK logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property and copyright work of, INARTIK or its licensors and is protected by copyright, trademarks, patents or other intellectual property rights and laws. The compilation of the content on the Platform. is the exclusive property and copyright of, INARTIK and is protected by copyright, trademarks, patents, or other intellectual property rights and laws. |

INARTIK and related logos are the trademarks of INARTIK. INARTIK trademarks may not be used in connection with any product or Service that is not listed on the Platform or in any manner that disparages or discredits, INARTIK. |
|
Data Privacy and Confidentiality |
|
You hereby agree to the collection and processing of Your personal data by INARTIK. We are committed to protecting the personal data in accordance with Our Privacy Policy. |

Disclaimer |
|
You will use the services at your own risk. the services are provided “as is” and “as available.” INARTIK disclaim all representations and warranties, express, implied, or statutory, not expressly set out in these terms. in addition, INARTIK make no representation, warranty, or guarantee regarding the reliability, timeliness, quality, suitability, or availability of the services or any services requested using the services, or that the services will be uninterrupted or error-free. INARTIK does not guarantee the quality, suitability, or ability of the services. You agree that the entire risk arising from the use of services remains solely with you, to the maximum extent permitted under applicable law. |

all accounts registered with INARTIK are continuously tracked for security purposes and performance reasons |
|
Limitations of Liability |
|
INARTIK shall not be liable to You for indirect, incidental, special, exemplary, punitive, or consequential damages, lost data, or damage to Your bank account or Your INARTIK account, even if INARTIK has been advised of the possibility of such damages. INARTIK shall not be liable for any damages, liability, or losses incurred by You arising out of Your use of or reliance on the Services or Your inability to access or use the Services or any transaction, even if INARTIK has been advised of the possibility of such damages. |

INARTIK shall not be liable for delay or failure in performance resulting from causes beyond INARTIK `s reasonable control. These limitations do not purport to limit liability that cannot be excluded under the Applicable laws. |
|
INARTIK shall be entitled to disclose any User information it may possess to affiliated corporate entities within its group of companies, or if required by law, or if requested or directed to do so by any official government body. INARTIK will do so at its sole discretion or as We may determine to be suitable or in Our best interest to do so. |
|
INARTIK shall be entitled to add to, vary or amend any or all these Terms and Conditions at any time without notice. The User shall be bound by any additions, variations, or amendments once incorporated into these Terms and Conditions on INARTIK Platform. |
|
These limitations do not purport to limit liability that cannot be excluded under the Applicable laws. |
|
Indemnification |
|
You agree to indemnify and hold INARTIK, its affiliates, sponsors, partners, directors, officers, and employees harmless from and against, and to reimburse INARTIK with respect to, any and all losses, damages, liabilities, claims, judgments, settlements, fines, costs and expenses (including reasonable related expenses, legal fees, costs of investigation) arising out of or relating to Your breach of this Terms & Conditions, along with Our Privacy Policy or use by You or any service provider of the same Services. |

Exceptions |
|
In cases of emergencies or force majeure, exceptions to this policy may be considered at the discretion of the Inartik Platform management. In such cases, users must contact the INARTIK Platform support team to submit an exception request with a detailed explanation of the force majeure circumstances and supporting evidence. The support team will respond to the user with a decision to approve or deny the request. |

Refund policy |
|
INARTIK apply the provisions of the Consumer Protection Law No. 181 of 2018 regarding the exchange/ refund policy. |
|
INARTIK will reserve the right to cancel the order at any time at its sole discretion and shall notify You on the cancellation via text messages or the Platform. No amount will be charged in such a case. |
|
Force Majeure |
|
INARTIK shall not be liable for any delay, interruption, or failure in the provisioning of Services if caused by acts of God, including but not limited to declared or undeclared war, fire, flood, storm, slide, earthquake, power failure, "Force Majeure”, the inability to obtain equipment, supplies or other facilities that are not caused by a failure to pay, labor disputes, or other similar events beyond Our control that may prevent or delay Service provisioning. |

Links to Third Party Platforms |
|
Our Platform may contain hyperlinks to platforms operated by parties other than INARTIK Such hyperlinks are provided for your reference only. We do not control such platforms and are not responsible for their contents or the privacy or other practices of such platforms. These Terms and Conditions will not apply to your use of any third-party platform that you access via our Platform. Your use of any third-party platform may be subject to additional terms and conditions, which we suggest you read carefully before you visit any such platform. |

Applicable Laws |
|
The rights and obligations of the parties pursuant to this Terms & Conditions are governed by and shall be construed in accordance with the laws of the Arab Republic of Egypt. |
|
You hereby irrevocably submit to the exclusive jurisdiction of the Courts of the Arab Republic of Egypt for any dispute arising under or relating to this Terms & Conditions and waive Your right to institute legal proceedings in any other jurisdiction. We shall be entitled to institute legal proceedings in connection with any matter arising under these Terms & Conditions in any jurisdiction where you reside, do business, or have assets. |
|
Where there is any dispute or inconsistency arising from the text of these Terms &Conditions, the Arabic version shall prevail. |
|
Unenforceable Provisions |
|
If any part of these Terms & Conditions is found to be invalid or unenforceable under Applicable law, such part will be ineffective to the extent of such invalid or unenforceable part only, without affecting the remaining parts of the Terms &Conditions in any way. |
|
Entire Agreement |
|
This Agreement along with INARTIK Privacy Policy constitute the entire Agreement between You and INARTIK regarding the use of the Platformand the Services and supersedes all previous negotiations or agreements both orally or in writing regarding the subject matter of this Agreement. |
|
We reserve the right, at Our sole discretion and at any time, to update, change or replace any part of these Terms and Conditions by posting updates and changes to Our Platform. It is Your responsibility to check Our Platform periodically for changes. Your continued use of or access to the Platform or the Service following the posting of any changes to these Terms & Conditions constitutes acceptance of those changes. |

Third Party Services |
|
The Services may be made available or accessed through Third-Party Service Providers and content (including advertising) that INARTIK do not control. INARTIK do not endorse such third-party services and content and in no event shall INARTIK be responsible or liable for any of the services of these Third-Party Service Providers. |

يرد فيما يلي الشروط والأحكام التي تسري بشأن عملية استخدام منصة "انارتك" وكذا كل ما يرتبط به من مواقع وخدمات، علما بأن استخدام المنصة الإلكترونية " انارتك" إذ يعتبر بمثابة موافقة من جانبكم على الشروط والأحكام الماثلة. وإذا لم توافقوا على هذه الشروط والأحكام، فيكون عليكم عدم الدخول على المنصة أو استخدامها. |

تطبق الشروط والأحكام التالية على جميع المستخدمين فيما يتعلق بالخدمات المقدمة من المنصة " انارتك ". تدخل هذه الشروط والأحكام حيز التنفيذ بمجرد قبولك للخدمة من خلال المنصة أو من خلال أي شكل آخر من أشكال التواصل مع انارتك. |

ونرجو الإحاطة بأنه ينبغي مُراجعة سياسة الخصوصية السارية لدينا على (رابط سياسة الخصوصية) والمُوافقة عليها باعتبارها جزءً لا يتجزأ من هذه الشروط والأحكام. |

تحل هذه الاتفاقية محل أي اتفاقيات أو ترتيبات سابقة بينك وبين انارتك، ويجوز انارتك إنهاء هذه الاتفاقية و/أو أي توفير للخدمات بموجبها على الفور، أو التوقف بشكل عام عن تقديم أو رفض الوصول إلى الخدمات أو أي جزء منها وفقا لتقديره الخاص، في أي وقت ولأي سبب، دون تحمل أي مسؤولية تجاهك. |

يُـوافق المستخدم، بل ويقبل بأن يكون استخدام المنصة الإلكترونية والخدمات التي يقدمها انارتك استخداما يسري على مسئوليته الخاصة، كما يُـقر أيضا بأن انارتك إذ تبرأ، بل وتعفى من أية إقراراتٍ أو ضماناتٍ من أي نوع، سواءً صدرت صراحة أو ضمنًا. |

تعريفات |
|
تسري التعريفات التالية على الشروط والأحكام المعروضة أدناه، علما بأن هذه الشروط والأحكام هي وسياسة الخصوصية إذ تعتبر وبموجب هذه المُحرر كل ما تم الاتفاق عليه والتفاهم بشأنه فيما بين" انارتك" و "المستخدم"، سواء كان المستخدم في صورة شخص أو كيان يقوم بالدخول على المنصة الإلكترونية. |

يُـشير لفظ "نحن"، و "لنا"، و"لدينا"، و"الشركة"، و" انارتك " و"المنصة" إلى انارتك وعامليه والوكلاء المعتمدين لديه. |
|
المستخدمين: هم الأفراد الذين يستفيدون من خدمات المنصة والموضحة طبقا للشروط والاحكام الماثلة ويشمل ذلك "الأطفال" الذين يستخدمون المنصة تحت إشراف أولياء أمورهم. |
|
الخدمات: ويقصد بها خدمات انارتك الوارد بيانها وفق الشروط والاحكام الماثلة. |
|
المنصة الإلكترونية: يقصد به المنصة الإلكترونية "انارتك" والمملوكة لشركة انارتك لتجارة الملابس والمقيدة بسجل تجارى استثمار القاهرة تحت رقم 247989 والتي يتم الاستفادة من الخدمات المقدمة من خلالها من قبل المستخدمين. |
|
الأطفال: تُشير إلى المستخدمين من الأطفال الذين يستفيدون من خدمات المنصة. |
|
أولياء الأمور: تُشير إلى آباء أو أمهات أو الوصي القانوني على الأطفال الذين يستخدمون منصة "انارتك". |
|
القوة القاهرة: ويُـقصد بها أي حدث قدري، ومن ذلك على وجه العموم لا الحصر الحريق والفيضانات والعواصف والأعاصير والزوابع والنشاطات البركانية والزلازل، وكذا أية تصرفات أو أوامر أو طلبات تصدر من جهة سيادية أو حكومة و/أو أية هيئة يُـفترض أنها تعمل لصالح تلك الجهة، وكذا الحرب، سواء المعلنة أو غير المعلنة، والتصرفات المثيلة للحرب، والثورات، وحالات الشغب، والعصيان المدني، والاضطراب المدني، وكذا عمليات الإضراب، والتوقف عن العمل، و/أو ما شابة ذلك من حالات أو تصرفات تندرج ضمن النزاعات العمالية، وأي سبب آخر مثيل ويخرج عن نطاق تحكم أو سيطرة أي طرف، هذا ما لم يكن تنفيذه هو تنفيذ محل ضمان يسري بموجب تنازل صريح عن الإعفاء في حالة وقوع حدث القوة القاهرة. |
|
القوانين واجبة التطبيق: ويقصد بها القوانين السارية لدى جمهورية مصر العربية. |
|
الصلاحية |
|
وإذا قمتم بالتسجيل بصفتكم جهة عمل (شركة)، فيكون عليكم الإقرار بأن لديكم الصلاحية اللازمة لإلزام الكيان الخاص بكم بالشروط والأحكام الماثلة، وأنكم وكذا كيان العمل ستلتزمون بكل ما هو واجب التطبيق من قوانين واشتراطاتٍ تسري على وتخضع لها عملية استخدام المنصة. |
|
الحسابات والتسجيل |
|
للاستفادة من الخدمات، يجب عليك تقديم جميع المعلومات المطلوبة من أجل إنشاء حسابك والسماح لمنصة انارتك بتقديم الخدمات لكم. خلاف ذلك، يجب عليك استخدام المنصة الإلكترونية كضيف. |
|
قد تطلب منك منصة انارتك تقديم بعض البيانات الشخصية بما في ذلك على سبيل المثال لا الحصر اسمك الكامل وعنوان بريدك الإلكترونية ورقم هاتفك المحمول وبعض البيانات المالية الأخرى. |
|
ويكون عليكم الموافقة على ان يتم حفظ معلومات صحيحة ودقيقة وكاملة ومحدثة في حسابك. كما سيكون عليكم أن تتحملوا المسئولية عن كل نشاطٍ يجري في إطار حسابكم، كما تلتزمون بالموافقة على الحفاظ وباستمرار على سريان إجراءاتٍ أمنية على اسم المستخدم وكلمة المرور الخاصة بحسابكم، هذا ما لم تصرح انارتك بغير ذلك كتابة. |
|
وحيث أنه لا يجوز نقل أو حوالة حسابات المستخدمين، فلهذا يكون عليكم الموافقة على أن تردوا إلى انارتك قيمة أية عملية استخدام لحسابكم، ولم تكن عملية صحيحة أو مُصرح بها أو تسري وفق القانون، وحدث ذلك من جانبكم أو من جانب أي شخص يمكنه الدخول على المنصة أو الخدمات أو خلافه من خلال استخدام اسم المستخدم أو كلمة المرور المحددة من جانبكم، بل وسواء سمحتم بذلك الدخول أم لا. |
|
أنت توافق على أنك المسؤول الوحيد عن جميع الأنشطة التي تحدث فيما يتعلق بحسابك على منصة انارتك يجب عليك إخطارنا على الفور بأي استخدام غير مصرح به لحسابك. |
|
يجوز لنا إنهاء أو إيقاف الدخول على حسابك أو قدرتك على استخدام الخدمات، كليا أو جزئيا، وفقا لتقديرنا الخاص، لأي سبب أو بدون سبب، ودون إشعار أو مسؤولية من أي نوع. على سبيل المثال، يجوز لنا إنهاء أو تعليق حسابك أو قدرتك على استخدام الخدمات إذا أساءت استخدام المنصة الإلكترونية قد يمنعك أي إنهاء أو إيقاف من هذا القبيل من الوصول إلى حسابك. |

وإذا نما لدى انارتك (وحسب مطلق اختيارها) ثمة شكوك بأن أية معلومة من المعلومات التي تقدمتم بها هي معلومة غير صحيحة، أو غير دقيقة، أو غير كاملة، أو غير محدثة، دونما إخلال بأية حقوق أخرى وتعويضاتٍ مكفولة ل انارتك وفق الشروط والأحكام الماثلة أو بمقتضى القوانين واجبة التطبيق، فيكون لدينا الحق في إيقاف عملية دخولكم على المنصة الإلكترونية وخدماته، أو تحديد هذا الدخول أو قصره. |

ويجوز ل انارتك القيام (وحسب مطلق اختيارها، بل وفي أي حين) بإبداء أية استفسارات تراها ضرورية (سواء تم ذلك بصورة مباشرة أو من خلال طرف من الغير)، وكذا مطالبتكم بتقديم الرد وبمزيد من المعلومات أو المستندات، ومنها على وجه العموم لا الحصر معلوماتٍ ومستندات للتحقق من هويتكم و/أو ملكيتكم لسنداتكم المالية. ودونما تقييد لما سلف بيانه، فإذا كنتم بمثابة جهة عمل أو مسجلين بالنيابة عن جهة عمل، فيجوز أن تشمل هذه المعلومات أو المستندات الترخيص التجاري وغير ذلك من مستنداتٍ رسمية خاصة بالشركة و/أو مستنداتٍ تستعرض أية صلاحية مكفولة لأي شخص للعمل نيابة عنكم. ويكون عليكم الموافقة على توفير أية معلوماتٍ و/أو مستندات إلى انارتك فور طلبها إياها. كما يكون عليكم الإقرار والموافقة على أنه إذا تعذر عليكم القيام بذلك، فيجوز ل انارتك القيام ودونما أية مسئولية عليه بتقييد أو إيقاف أو سحب عملية دخولكم على المنصة الإلكترونية. كما نحتفظ أيضا بالحق في إلغاء أية حساباتٍ لم يرد تأكيد بشأنها أو لم يتم التحقق منها أو أية حساباتٍ لم تكن مفعلة لمدة طويلة. |

يجب أن يكون جميع المستخدمين المسجلين على المنصة أولياء أمور أو أوصياء قانونيين للأطفال الراغبين في المشاركة على المنصة الإلكترونية، يُرجى التأكد من أنك مسؤول قانونيًا عن الطفل المسجل على المنصة الإلكترونية. |

منصة انارتك تقدم مجموعة متنوعة من الخدمات التي تهدف إلى إعطاء تجربه مميزة و فريده لمستخدمي المنصة الإلكترونية المهتمين بشراء و تصفح منتجات الملابس: |

اولاً: التصنيفات و تفاصيل المنتجات توفر المنصة الإلكترونية تصنيفات متعددة للملابس مثل الملابس الرجالية، النسائية، الأطفال، الرياضة، والمناسبات الخاصة. لكل منتج صفحة تحتوي على صور عالية الجودة، تفاصيل عن المواد المستخدمة، المقاسات المتاحة، الأسعار، وألوان متعددة. |
|
ثانياً: العروض الخاصة و الخصومات تقوم المنصة الالكترونية إشعارات للمستخدمين حول العروض الترويجية، الخصومات، والمجموعات الجديدة. كما تقدم المنصة عروض خاصة خلال الأعياد والمواسم المختلفة، مما يساعد في جذب العملاء. |
|
ثالثاً: أدوات تساعد في عملية الشراء. الذكاء الاصطناعي: تقدم المنصة توصيات للملابس بناءً على تفضيلات المستخدم وتاريخ المشتريات، مما يسهل على العملاء العثور على ملابس تناسب ذوقهم. قائمة الأمنيات: تسمح للمستخدمين بإضافة منتجات إلى قائمة الأمنيات لمراجعتها وشرائها لاحقًا. كما توفر المنصة أداة لقياس الأبعاد الشخصية أو يقوم بتوجيه المستخدمين للحصول على القياسات الصحيحة، مما يساعد في اختيار المقاس المناسب للملابس. |

رابعاً: سياسة الاسترجاع والاستبدال توفر المنصة سياسة استرجاع مرنة تتيح للعملاء إعادة أو استبدال المنتجات بسهولة في حالة وجود عيوب أو عدم الرضا. كما يمكن للعملاء طلب استبدال المنتجات أو استرجاع المبالغ المدفوعة من خلال التطبيق. |

خامساً: طرق الدفع والشراء تشمل المنصة خيارات دفع مرنة مثل الدفع عند الاستلام، الدفع عبر البطاقة الائتمانية، أو الدفع الإلكتروني. كذلك يمكن للمستخدمين حفظ تفاصيل الدفع لعمليات شراء أسرع في المستقبل. |

سادساً: التوصيل والتعقب توفر المنصة خيارات توصيل متعددة كما يتيح للعملاء تتبع حالة شحنتهم في الوقت الحقيقي عبر التطبيق. |

سابعا: خدمة العملاء والدعم المباشر تتضمن المنصة الالكترونية خدمة دردشة مباشرة مع دعم العملاء لحل أي استفسارات أو مشاكل يواجها المستخدمون. كذلك يوجد قسم للأسئلة الشائعة لتوجيه العملاء وتوفير الوقت. |

استخدام المنصة الإلكترونية |
|
نظير التزام المستخدم بالشروط والأحكام الماثلة، تمنح انارتك إلى المستخدم ترخيصًا محدودا وغير حصري ولا يجوز منحه من الباطن وغير قابل للإلغاء أو الإبطال، بل وغير قابل للحوالة أو النقل فيما يتعلق بما يلي: |

- الدخول على الخدمات واستخدامها فيما يتعلق بعملية تقديم الخدمات وحسب. |
|
- الدخول على أي محتوى واستخدامه وكذا أية معلومات وما يرتبط بها من مواد قد تتوفر من خلال الخدمات. |
|
علما بأن أي حق لم يتم منحه على نحو صريح في هذه الشروط هو حق محفوظ ل انارتك، بل ويجوز إلغاؤه أو إبطاله في أي حين، بل ودونما أي إخطارٍ بذلك إلى المستخدم. |
|
ويحظر على المستخدم استخدام أية علامة تجارية أو أي حقوق ملكية فكرية ل انارتك كما لا يجوز إجراء أي هندسة عكسية أو إعادة تشكيل لها، أو القيام بربط أي جزء من الخدمات بأي نظام عاكس كما لا يجوز نسخ أو تأطير أي جزء من الخدمات أو إطلاق أي برامج أو نصوص برمجية لغرض كشط، أو فهرسة، أو إجراء مسح، أو استخراج البيانات من الخدمات بأي طريقة أخرى، أو إثقال كاهل أو إعاقة تشغيل أي جانب من جوانب الخدمات، أو محاولة الدخول على الخدمات غير المصرح به أو إضعاف أي جانب من جوانب الخدمات أو الأنظمة او الشبكات المرتبطة بها. |
|
ولا يجوز للمستخدم القيام في أي موضع آخر بالمنصة الإلكترونية (وذلك حسبما يتقرر وحسب مطلق اختيارنا) بأية عملية نشر للآتي: أية دعاية لغرض الاستقطاب، أو أية إعلانات، أو استخدام لغة مبتذلة، أو مواد تشوبها البذاءة أو تحتوي على سباب أو تجاوزات من الناحية الثقافية أو الدينية أو أي محتوى سياسي نقدي أو مواد من شأنها إحداث تهديد للصالح العام أو الأمن القومي أو التسبب في إساءة السمعة، أو القذف، أو التشهير، أو أي محتوى آخر قد تشوبه الإهانة أو البذاءة. |

تقدم انارتك بعض الأنشطة المغامرة التي قد تنطوي على مخاطر. نود التأكيد على أن مسؤولية ضمان سلامة جميع الرحلات تقع على عاتق المستخدم وحدة وبشكل كامل، ويجب على المستخدم اتباع قواعد مقدم الخدمة بدقة خلال الرحلة. |

عمليات التواصل الإلكترونية |

عند إنشاء حساب، يكون عليكم الموافقة على انكم ستتواصلون معنا إلكترونيا. وبالتالي، عليكم الموافقة على استلام رسائل دورية من جانبنا. وسوف يتواصل معكم انارتك عبر البريد الإلكتروني أو قد يرسل لكم معلومات عبر رسائل نصية قصيرة، وكذا القيام بنشر إخطاراتٍ على المنصة الإلكترونية كجزء من إدارة الأعمال المعتادة والتي ترتبط بعملية استخدامكم للخدمات. ويكون عليكم الإقرار بأن اختياركم عدم منصة وسائل التواصل المذكورة هو أمر من شأنه إحداث ثمة تأثير على عملية استخدامكم للخدمات. |

كما يكون عليكم الموافقة على أن تكون جميع الاتفاقات والإخطارات والا فصاحات وغير ذلك من مراسلاتٍ مما نقوم بتقديمها اليكم إلكترونيا هي مراسلاتٍ تستوفي أي اشتراط قانوني يستلزم تقديم تلك المراسلات على نحو كتابي. |

كما ستطلب منكم انارتك خلال عملية التسجيل الموافقة على أن نرسل لكم رسائل بريد إلكتروني أو إخطاراتٍ دعائية ترتبط بالمنصة وما به من خدمات. وإذا حدث في أي حين أن قررتم أو أبديتم عدم الرغبة في استلام رسائل البريد الإلكتروني الدعائية، فيمكنكم اختيار عدم استلامها من خلال الضغط على الرابط الكائن في أسفل أية رسالة بريد إلكتروني دعائية. |
|
المدفوعات |
|
يوفر انارتك خدمات سداد إلكتروني من خلال بوابات الدفع الإلكترونية. وسيتم معالجة الدفع من خلال هذه البوابات، ولا يتحمل انارتك أي مسؤولية عن أي خطأ أو ضرر أو أي أمر مثيل قد يتعرض له المستخدم من واقع أو جراء استخدام وسيلة السداد الإلكترونية، حيث يقع ذلك على مسؤولية المستخدم. |
|
تحتفظ انارتك بالحق في تغيير أو تعديل طرق الدفع ورسوم الخدمات دون إشعار مسبق. ومع ذلك، ستنعكس هذه التغييرات على المنصة قبل طلبك. |
|
ويكون عليك أن تضمن وجود تغطية مالية كافية في الحساب ذو الصلة، بحيث يُمكن تغطية الخدمات المقدمة، كما يكون عليك الالتزام بحدود معاملات بطاقة الائتمان. يوافق المستخدم على استلام إيصال عبر البريد الإلكترونية أو الرسائل النصية أو من خلال المنصة نفسه بعد دفعك للرسوم. |
|
ولا تفرض انارتك أية رسوم إضافية على المستخدمين من واقع إجراء عملية السداد إلكترونيا فيما عدا المصاريف الإدارية التي تمثل نسبة (............) % من المدفوعات. |
|
ويجوز لمنصة انارتك القيام (وحسب مطلق اختياره، بل وفي أي حين) بإبداء أية استفساراتٍ يراها ضرورية (وذلك سوءا بصورة مباشرة أو من خلال الغير)، كما يجوز له أن يطلب منكم موافاته بالمزيد من المعلومات أو المستندات، ومن ذلك على وجه العموم لا الحصر أية معلومات أو مستندات تلزم للتحقق من هويتكم و/أو ملكيتكم للسندات المالية. ويكون عليكم بالتالي الموافقة على توفير أية معلوماتٍ و/أو مستنداتٍ إلى انارتك فور طلبه إياها. كما يكون عليكم الإقرار والموافقة على أنه إذا تعذر عليكم ذلك، فيجوز ل انارتك القيام ودونما أية مسئولية عليها بإلغاء المعاملة أو تقييد أو إيقاف إمكانية دخولكم على المنصة أو سحب عضويتكم منه. |

حقوق التأليف والعلامات التجارية |
|
بالنسبة لجميع المحتوى الوارد على المنصة الإلكترونية، ومن ذلك على وجه العموم لا الحصر النص، وصور الجرافيك، وشعارات انارتك ، والازرار، والصور، والمقاطع الصوتية، وعمليات التحميل الرقمي، وتجميع البيانات، والبرامج الإلكترونية، فيعتبر ذلك المحتوى بمثابة ملكية، بل وعمل خاص ب انارتك أو بمرخصيه. كما يخضع هذا المحتوى للحماية بموجب حق المؤلف وحقوق العلامات التجارية وبراءات الاختراع وغير ذلك من حقوق ملكية فكرية وقوانين. كما يكون المحتوى المجمع على المنصة بمثابة ملكية حصرية ل انارتك وحق تأليف لها، بل ويخضع للحماية بموجب حق المؤلف وحقوق العلامات التجارية وبراءات الاختراع وغير ذلك من حقوق ملكية فكرية وقوانين. |

وتعتبر علامة انارتك وما يرتبط بها من رموز هي علاماتٍ تجارية خاصة ب انارتك، علما بأنه لا يجوز استخدام العلامات التجارية انارتك فيما يتعلق بأي منتج أو أية خدمة ليست معروضة على المنصة، أو أي منتج أو خدمة من شأنها التقليل من شأن انارتك أو الإساءة لسمعتها. |
|
سرية البيانات والخصوصية |
|
أنت توافق بموجب هذه الاتفاقية على جمع ومعالجة بياناتك الشخصية من قبل انارتك، نحن ملتزمون بحماية البيانات الشخصية وفقا لسياسة الخصوصية الخاصة بنا. |
|
الإبراء من المسئولية |
|
سوف تستخدم الخدمات على مسؤوليتك الخاصة. يتم تقديم الخدمات "كما هي" معروضة و"حسبما هو متاح" منها. وتعفى انارتك، بل وتبرأ من كافة الإقرارات والضمانات الصريحة منها أو الضمنية أو القانونية التي لم يرد نصها صراحة في الشروط الماثلة. كما لا يتقدم انارتك بأي إقرار أو ضمان بشأن مصداقية الخدمات، أو دقة مواعيدها، أو جودتها، أو استدامتها، أو توافرها هي، أو أية خدمات تطلب من خلال استخدام خدمات انارتك، كما لا تضمن انارتك عدم تعرض الخدمات للتعطيل أو خلوها من الخطأ، ولا تمنح انارتك أي ضمان بشأن جودة الخدمات وملاءمتهم وقدراتهم. ولهذا يكون عليكم الموافقة على تحملكم حصرا كامل المسئولية الناشئة عن استخدامكم الخدمات، وذلك إلى أقصى حد يسمح به القانون واجب المنصة. |
|
وتعتبر جميع الحسابات المسجلة على انارتك هي حسابات محل متابعة مستمرة، وذلك لأغراض أمنية ولأسبابٍ تتعلق بالأداء. |
|
حدود المسئولية |
|
لا تتحمل انارتك المسئولية تجاهكم عن أية أضرارٍ مباشرة، او غير مباشرة، أو أضرار عارضة، أو خاصة، أو جزائية، أو عقابية، أو تبعية، ومن ذلك فقد البيانات أو اي اضرار بحسابكم الشخصي في البنك او حسابكم على انارتك، وذلك، حتى لو كانت انارتك قد احيطت علمًا باحتمال وقوع هذه الاضرار. ولا تتحمل انارتك المسئولية عن أية أضرار أو أية مسئولية أو أية خسائر تتحملونها وتنشأ من واقع استخدامكم للخدمات أو اعتمادكم عليها أو جراء عدم تمكنكم من الدخول على الخدمات أو استخدامها وذلك، حتى لو تم إحاطة انارتك بإمكانية وقوع تلك الاضرار. |
|
لن تكون انارتك مسؤولة عن التأخير أو الفشل في الأداء الناتج عن أسباب خارجة عن سيطرة انارتك المعقولة. لا تهدف هذه القيود إلى الحد من المسؤولية التي لا يمكن استبعادها بموجب القوانين المعمول به. |
|
ويكون من حق انارتك الإفصاح لأي مِمَّا في حيازته معلومات تخص المستخدم وذلك إلى الكيانات المؤسسية التابعة ل انارتك والكائنة ضمن مجموعة شركاته او أن استلزم القانون ذلك أو إن طـُـلب أو صدر توجيه بذلك من جانب أية جهة حكومية رسمية. وسيقوم انارتك بذلك حسب مطلق اختياره أو حسبما قد يتقرر ملاءمته من جانبنا أو إن كان ذلك الإفصاح أمرا ينصب في مصلحتنا. |
|
ويكون من حق انارتك إجراء أية إضافة إلى الشروط والاحكام الماثلة أو التغيير أو التعديل فيها في أي حين ودونما إخطار بذلك. ويكون على المستخدم الالتزام بأية إضافات أو تغييرات أو تعديلاتٍ حين إدراجها في متن الشروط والاحكام الماثلة على منصة انارتك. |
|
ولا تعتبر حدود المسئولية المذكورة أمرا من شأنه تقييد المسئولية التي لا يجوز استثنائها وفق القوانين واجبة المنصة. |
|
التعويض |
|
يكون عليكم الموافقة على تعويض انارتك بل وتجنيبها الضرر هي وكياناتها التابعة وجهات الرعاية لديها وشركائها ومدراءها ومسئوليها وعامليها من أية ضرر بل ومن جميع الخسائر والتعويضات والمسئوليات والدعاوى والاحكام القضائية والتسويات والغرامات والتكاليف والمصروفات (ومنها ما هو معقول من مصروفات قانونية واتعاب محاماة وتكاليف تحقيق) بل وصرف قيمتها إلى انارتك ،وذلك إذا كانت هذه المصروفات تنشأ او ترتبط بأي إخلال يقع من جانبكم بالشروط والاحكام الماثلة أو بسياسة الخصوصية السارية لدينا أو باستخدامكم أو أي مقدم خدمات للخدمات الماثلة. |
|
استثناءات |
|
في حالات الطوارئ أو الظروف القهرية، يمكن النظر في استثناءات لهذه السياسة بناءً على تقدير إدارة منصة انارتك وفى تلك الحالة يجب التواصل مع فريق الدعم لمنصة انارتك لتقديم طلب استثناء مع توضيح الظروف القهرية وتوضيح الدلائل التي تُثبت وجود الظروف القهرية وسيتم الرد على المستخدم من قبل فريق الدعم بالقبول او رفض الطلب. |
|
سياسة الاسترداد |
|
تطبق انارتك أحكام قانون حماية المستهلك رقم 181 لسنة 2018 فيما يتعلق بسياسة الاسترجاع السارية لديها. |
|
تحتفظ انارتك بالحق في إلغاء الطلب في أي وقت وفقا لتقديرها الخاص وستقوم بإخطارك بالإلغاء عبر الرسائل النصية أو المنصة. لن يتم فرض أي مبلغ في مثل هذه الحالة. |
|
القوة القاهرة |
|
لا تتحمل انارتك المسئولية عن أية حالة تأخير أو تعطيل أو إخفاق في تقديم الخدمات إذا كان السبب في ذلك يرجع لأية أحداث قاهرة، ومنها على وجه العموم لا الحصر حالة الحرب (سواء كانت معلنة أو غير معلنة) والحريق والفيضان والعاصفة والانزلاق والزلزال وانقطاع الكهرباء "القوة القاهرة" وعدم القدرة على الحصول على المعدات أو التوريدات أو غير ذلك من مرافق أو تسهيلات، وكان ذلك لا يرجع لأي إخفاق في السداد، والنزاعات العمالية أو ما شابة ذلك من أحداث خارجة عن نطاق التحكم من جانبنا وكان من شأنها منع تقديم الخدمات أو تأخيرها. |
|
روابط مواقع الطرف الثالث |
|
قد يحتوي منصة انارتك الإلكترونية على روابط لمواقع إلكترونية تديرها أطراف أخرى غير انارتك يتم توفير هذه الروابط للرجوع إليها فقط. نحن لا نتحكم في هذه المواقع ولسنا مسؤولين عن محتوياتها أو الخصوصية أو الممارسات الأخرى لهذه المواقع. لن تنطبق هذه الشروط والأحكام على استخدامك لأي منصة وتابع لجهة خارجية تصل إليك عبر منصة انارتك الإلكترونية. قد يخضع استخدامك لأي منصة تابع لجهة خارجية لشروط وأحكام إضافية، والتي نقترح عليك قراءتها بعناية قبل زيارة أي منصة من هذا القبيل. |
|
القوانين واجبة التطبيق |
|
تخضع الحقوق والالتزامات الخاصة بالأطراف وفق الشروط والاحكام الماثلة، بل وتفسر وتؤول بما يتوافق وقوانين جمهورية مصر العربية. |
|
كما أنكم وبموجب هذا المُحرر إذ تخضعون ودون قيد أو شرط لمناط الاختصاص الحصري لمحاكم جمهورية مصر العربية، وذلك بالنسبة لأية منازعات تنشأ من واقع الشروط والاحكام الماثلة أو فيما يتعلق بها، كما يتعين عليكم التنازل عن أي حق لكم في اتخاذ أية إجراءات قانونية في أية منطقة أو مناط اختصاص آخر، في حين يكون من حقنا اتخاذ إجراءات قانونية فيما يتعلق بأي موضوع ينشأ بصدد الشروط والاحكام الماثلة في أية منطقة تقيمون فيها أو تجرون بها أعمالكم أو يكون لكم بها أية أصول. |

في حالة وقوع أي نزاع أو ثمة تعارض ينشأ من واقع نص الشروط والاحكام الماثلة، فيسري حينئذٍ النص العربي. |
|
الأحكام المقرر عدم سريانها |
|
إذا تقرر عدم صلاحية أي جزء من الشروط والأحكام الماثلة أو عدم سريانها أو نفاذها وفق القانون واجب التطبيق، فيعتبر حينئذٍ ذلك الجزء بمثابة غير ساري أو نافذ في حدود ما هو مقرر عدم صلاحيته أو سريانه أو نفاذه وحسب، ودون أن يؤثر ذلك وبأي حال من الأحوال على باقي أجزاء الشروط والأحكام. |

مُجمل الاتفاق |
|
تشكل هذه الاتفاقية إلى جانب سياسة الخصوصية الخاصة بمنصة انارتك الاتفاقية الكاملة بينك وبين انارتك فيما يتعلق باستخدام المنصة والخدمات وتحل محل جميع المفاوضات أو الاتفاقيات السابقة شفهيا أو كتابيا فيما يتعلق بموضوع هذه الاتفاقية. |
|
نحن نحتفظ بالحق، وفقا لتقديرنا الخاص وفي أي وقت، في تحديث أو تغيير أو استبدال أي جزء من هذه الشروط والأحكام عن طريق نشر التحديثات والتغييرات على المنصة. تقع على عاتقك مسؤولية التحقق من منصة انارتك بشكل دوري لمعرفة التغييرات. استمرار استخدامك أو الوصول إلى المنصة أو الخدمة بعد نشر أي تغييرات على هذه الشروط والأحكام يشكل قبولا لهذه التغييرات. |

يمكنك مراجعة أحدث إصدار من هذه الشروط والأحكام في أي وقت على منصة انارتك. |
|
خدمات الغير |
|
قد يتم توفير خدمات أو الوصول إليها من خلال مقدمي خدمة من الغير وكذا عبر محتوى (ومن ذلك أي محتوى إعلاني) لا يخضع لنطاق سيطرة أو تحكم انارتك. ولهذا يكون عليكم الإقرار بأن هناك شروط استخدام مختلفة، بل وسياسات خصوصية أخرى قد تسري عليكم حين استخدام خدمات ذلك الغير وذلك المحتوى. إلا أن انارتك لا تمنح أيما تصديق على خدمات الغير أو ما يخصهم من محتوى، بل ولا تتحمل انارتك أية مسئولية أو التزام من أي نوع عن أية خدمة من تلك الخدمات الخاصة بمقدمي الخدمة من الغير. |
